FIVE POINTS FILM INSTITUTE, INC.
SUMMER FILM CAMP 2026 — PARTICIPANT AGREEMENT, WAIVER & RELEASE OF LIABILITY, ASSUMPTION OF RISK, INDEMNIFICATION, MEDICAL AUTHORIZATION, AND PROGRAM POLICIES
This Agreement is entered into by the parent or legal guardian ("I," "me," or "Parent/Guardian") of the registered minor participant ("Participant" or "my child") in consideration of the Participant being permitted to enroll in and attend the Five Points Summer Film Camp (the "Program") operated by Five Points Film Institute, Inc. and its affiliate Five Points Media, Inc. (collectively, the "Institute"). The Program is held July 20–31, 2026 (Monday–Friday) at You 42 Studios, 11000 Alpharetta Hwy, Roswell, GA, and at any approved off-site locations used for instruction, filming, or activities. By checking the agreement box and typing my name below, I acknowledge that I have read, understood, and voluntarily agreed to every provision of this Agreement, and that this electronic signature is legally binding to the same extent as a handwritten signature.
1. Eligibility & Accurate Information
I confirm that my child meets the Program's age requirement (13–17) and that all information provided in this registration — including medical, allergy, emergency contact, and authorization details — is true, accurate, and complete to the best of my knowledge. I agree to promptly notify the Institute in writing of any change to this information before or during the Program.
2. Description & Inherent Risks of the Program
I understand the Program is a hands-on filmmaking intensive that involves activities including but not limited to: the handling and operation of cameras, lighting instruments, electrical and grip equipment, tripods, stands, rigging, and audio gear; movement on and around active production sets; lifting and carrying of equipment; use of hand tools and props; participation in on-camera performance and physical blocking; group activities; use of computers and editing stations; and travel and movement between indoor and outdoor locations. I understand these and other activities carry inherent and other risks that cannot be eliminated regardless of the care taken, including but not limited to: minor and serious bodily injury, cuts, burns, falls, strains, fractures, electrical shock, eye strain, illness (including communicable illness), property damage or loss, emotional distress, and in rare circumstances permanent disability or death.
3. Assumption of Risk
Knowing, understanding, and appreciating these risks, I voluntarily and knowingly assume all risks — both known and unknown, anticipated and unanticipated — associated with my child's participation in the Program, and I accept full and complete responsibility for any injury, loss, or damage that my child or I may suffer arising out of or in any way connected to participation in the Program.
4. Release & Waiver of Liability
To the fullest extent permitted by law, I, on behalf of myself, my child, and our respective heirs, executors, administrators, successors, and assigns, hereby RELEASE, WAIVE, DISCHARGE, and COVENANT NOT TO SUE the Institute and its parent and affiliated entities, and each of their respective directors, officers, members, employees, independent contractors, instructors, mentors, volunteers, agents, insurers, sponsors, partners, and the owners and operators of any venue or property used by the Program (collectively, the "Released Parties"), from any and all liability, claims, demands, actions, causes of action, costs, and expenses of any nature whatsoever, including those arising from the ordinary negligence of any of the Released Parties, which I or my child may have or which may accrue arising out of or related to any loss, damage, injury, illness, or death sustained in connection with the Program. I understand that I am giving up substantial legal rights, including the right to sue the Released Parties.
5. Indemnification & Hold Harmless
I agree to INDEMNIFY, DEFEND, and HOLD HARMLESS the Released Parties from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees and litigation costs) brought by or on behalf of my child, myself, or any third party, arising out of or related to my child's participation in the Program, my child's conduct, or any breach of this Agreement, except to the extent caused by the gross negligence or willful misconduct of a Released Party.
6. Medical Treatment Authorization
In the event of injury, illness, or a medical emergency, and if I cannot be reached immediately, I authorize the Institute's staff to administer or obtain first aid and to arrange for such emergency medical care and transportation (including ambulance and hospital treatment) as may be deemed necessary by qualified personnel for my child's health and safety. I consent to such treatment and authorize licensed medical providers to render care. I represent that my child is physically able to participate, and I disclose any conditions, allergies, and medications in this registration. I accept full financial responsibility for any and all medical, ambulance, hospital, or related costs incurred, and I confirm my child has adequate health insurance or that I will be responsible for all costs of care.
7. Allergy, Medication & Health Acknowledgment
I have disclosed all known allergies (including food allergies and their severity), medical conditions, and medications in this registration. I understand the Institute is not a medical provider and will make reasonable efforts to accommodate disclosed needs but cannot guarantee an allergen-free or risk-free environment. I am responsible for providing any required medication (clearly labeled) and any specific care instructions.
8. Photography, Film, Media & Likeness Release
I understand the Program is a filmmaking program and that photographs, video, audio, and creative work product featuring my child will be created. As indicated by my responses in the Media Release section of this registration, I grant (or withhold) permission for the Institute to record, reproduce, publish, display, and distribute such images, recordings, and work — in whole or in part — for educational, promotional, marketing, archival, and program-documentation purposes, across any media now known or later developed, without compensation, royalty, or further approval. Where I have indicated I do NOT agree, the Institute will make reasonable efforts to honor that election. I release the Released Parties from any claim related to the use of such media, including claims for defamation, invasion of privacy, or right of publicity.
9. Behavior, Conduct & Dismissal
I agree that my child will follow all Program rules, safety instructions, and staff directions. The Institute reserves the right, in its sole discretion, to remove or dismiss any participant whose behavior is disruptive, unsafe, or harmful to others, or who violates Program policies, without refund. I accept responsibility for any damage to equipment, property, or facilities caused by my child's intentional misconduct or gross negligence.
10. Drop-off, Pick-up & Supervision
I authorize only the individuals named in this registration to drop off and pick up my child and acknowledge that the Institute will not release my child to anyone not authorized. I am responsible for timely drop-off and pick-up. Supervision is provided only during scheduled Program hours.
11. Tuition & Refund Policy
I understand that a spot is not held until full tuition is received, and that tuition is due in full before the first day of the Program (July 20, 2026). Except where required by law, tuition payments are non-refundable; the Institute may, in its sole discretion, consider credits or transfers in extraordinary circumstances.
12. Program Changes, Cancellation & Force Majeure
The Institute reserves the right to modify the schedule, curriculum, staff, locations, or activities, and to cancel or suspend the Program, in whole or in part. The Institute shall not be liable for any failure or delay in performance, or for cancellation, due to causes beyond its reasonable control, including but not limited to acts of God, severe weather, fire, flood, public health emergencies, epidemic or pandemic, government orders, utility or facility failures, or other force majeure events. In the event of cancellation by the Institute prior to the Program for reasons within its control, the Institute's sole obligation shall be limited to a credit or refund of amounts paid.
13. Personal Property
I understand that the Institute is not responsible for lost, stolen, or damaged personal property belonging to my child, including phones, electronics, and personal equipment.
14. Communicable Illness Acknowledgment
I understand that any group program carries the risk of exposure to communicable illnesses. I assume this risk and agree not to send my child to the Program while contagious or exhibiting symptoms of illness.
15. Governing Law, Venue & Severability
This Agreement shall be governed by and construed under the laws of the State of Georgia, without regard to conflict-of-laws principles. I agree that any dispute arising out of or relating to this Agreement or the Program shall be brought exclusively in the state or federal courts located in Fulton County, Georgia, and I consent to the personal jurisdiction of those courts. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving its intent to provide the broadest protection to the Released Parties permitted by law.
16. Entire Agreement & Acknowledgment
This Agreement constitutes the entire agreement between the parties regarding its subject matter and supersedes any prior representations. I acknowledge that I have read this entire Agreement, that I understand it is a release of liability and a binding contract, that I have had the opportunity to seek independent legal counsel, and that I am signing it freely and voluntarily on behalf of myself and my child. If I am signing as the legal guardian of the Participant, I represent that I have full legal authority to do so.
